The Proponents of AI-Qiyaas
Some evidences of the proponents of qiyas.
One: Allaah says: "He it is Who drove out the disbelievers among the people of the Scripture (i.e. the Jews of Banu An-Nadir) from their homes at the first gathering. You did not think that they would get out. And they thought that their fortresses would defend them from Allaah! But Allaah's (Torment) reached them from a place whereof they expected it not. and He cast terror into their hearts so that they destroyed their own dwellings with their own hands and the hands of the believers. So ponder, 0 you with eyes (to see)." (Q59[Hashr]: 2)
The point of evidence in this verse is that Allaah having narrated the story of Banu An-Nadir who disbelieved in Him and what became of them, said: "So ponder, O you with eyes (to see) (,i.e.: compare yourselves to them since you are human beings like them and if you do something similar, a similar punishment would befall you)."
Two: Allaah says: "He put forth for Us a parable and forgets his creation. He says: "Who will give life to these bones after they are rotten and have become dust?" Say: (O Muhammad sallallahu alayhi wasallam.) "He will give life to them Who created them for the first time! And He is the All-Knower of every creation!" (Q36[YaasinJ:78-79).
The point of evidence in this verse is that Allaah the Exalted proved with qiyas what those who denied Resurrection rejected. He did this by comparing the raising up of the creatures after they have been decayed with the beginning of their creation at the first time. This is to convince the deniers of the Resurrection that Allah Who was capable of creating something for the first time is capable of returning it; it is even easier to do this. In addition to these, all parables in the Quran constitute a kind of qiyas.
Three: Ibn Abass narrated that a woman from the tribe of Juhaina came to the Prophet (sallallaahu alayhi wa sallam) and said: "My mother had vowed to perform Hajj but she died before performing it. May I perform Hajj on my mother’s behalf?" The Prophet replied, "Perform Hajj on her behalf Had there been a debt on your mother, would you have paid it or not? So, pay AIlaahs debt as He has more right to be paid." (Bukhari)
Four: Umar, may Allaah be pleased with him once said, "I was excited one time and I kissed [my wife] while Iwas fasting. I went to the Prophet and said: Today I committed a horrendous act I kissed while I was fasting. The Prophet asked "What do you think of rinsing with water while fasting? I said: There is nothing wrong with that. The Prophet said: Then what is the question about? (Abu Dawood)
Five: Abu Hurayrah narrated that a man came to the Prophet (sallallaahu alayhi wa sallam) from Banu Fazaarah and said: "My wife has delivered a black baby and the Prophet (sallallaahu alayhi wa sallam) said: "Do you have camels? He (the man) answered Yes "What are their colours? He said:"Red" "Are there the ones with grey colour? He said: Yes there are ones with grey colour. He (the Prophet, sallallaahu alayhi wa sallam) said: "How did they get that (colour)? He (the man) said "May be it is because of heredity. He (the Prophet, sallallaahu alayhi wa sallam) said, "May be this is also because of heredity." (Abu Dawood)
